I'm really not sure about this at all, but unless you tell your doctors who the father of the child is in relationship to you, they don't run any genetic tests on the baby, and would not be able to tell who the father was. The only way they would run tests is if the child was born with birth defects...even then I'm not too sure how they would do that.
The only way your brother could go to jail would be if you two were actually caught "in the act." I'm not 100% on this and hopefully there is someone out there with more knowledge than me. Lfmor

Thank you for the help you gave..I have been reading the post on here for a week now..I'm trying to educate myself the best way I can on GSA, and everything that you can expect, and the hurt, pain, struggle, happiness, and love to make it long lasting for me and my Half brother. He goes by ShedMyskin on here..Neways I just want anyone who would like to share there thoughts and experiences with us to please step foward and help us..Our family does not support us at all..There against it in everyway..We are open about this relationship to a certain extent..Close friends know and they support and respect our choices..Any point of view we would lov to here from anybody..Thats what this site is for right??? for us to feel welcome and not alone in this complication..Once again Thank you for your help.. couRAGEous Last edited by couRAGEous : 11-01-2007 at 01:31 AM. Hello everyone.
I already PMed this link to your brother, couRAGEous, but everyone else may find it useful. It's the National District Attorneys' Association summary of the incest laws in all 50 states plus the District of Columbia. http://www.ndaa.org/pdf/ncpca_statute_incest_06.pdf While the penalties for "incest" (which unfortunately is the category that consensual adult GSA relationships still find themselves lumped into) are far less severe than those prescribed in the book of Leviticus, they are still pretty darn severe. Note, however, that it varies widely from state to state. Delaware is the most lenient, considering intercourse between relatives to be a misdemeanor. Idaho seems the strictest, where the maximum penalty is life imprisonment. Outside of the United States it is a far different matter. Sweden seems to be the only country in which marriage between half-siblings is legal, but it is a complicated process, and it appears that one of the partners must have Swedish citizenship. France, of course, threw out the laws forbidding incest shortly after the Revolution (liberte, egalite, fraternite, you know), and Belgium, Holland, Luxembourg, Turkey and Portugal have done the same. Closer to home (at least for those in the US), Brazil and Argentina also have decriminalized consensual "incest," and across the Pacific, Japan (where I currently reside) has done the same. This is not to say that the universal taboo does not still exist in these countries. It does. The civilized world has finally, if grudgingly, made a place in its heart for Gay Pride parades, but a GSA Pride parade is still a long time in coming. More's the pity. Anyway, hope this helps. Best wishes to all. |

The other thing to keep in mind about the laws of many of the states is that many only criminalize actual intercourse, and in many cases do not punish the woman at all. The burden of proof is on the state to prove that actual intercourse occured, and unless you testify against your brother (which you certainly would not do), the state has no case.
Obviously, if they were really out to get you they could subpoena your gynocologist or obstetrician, or conduct a paternity test on your baby, but I think a good attorney could probably contest the witness on the grounds that his or her testimony would violate rules of doctor-patient confidentiality. I admit that I'm not an attorney myself, so I could certainly be wrong, but this is my understanding of the law. I hope I'm right, for my own sake as well. Good luck! |
